Acceptance of these terms

#

Using blokislabs.com and contracting any service provided by BLOKIS (operated by BlokisLabs, Cochabamba, Bolivia) implies acceptance of these terms. If you do not agree with them, we ask you not to use the site or contract the service.

These terms sit alongside the proposal signed or accepted in writing (email or formal document) for each project. In the event of a specific conflict, the individual proposal prevails over what is described here.

Scope of the services

#

BLOKIS provides professional services in software, automation, digital product, managed hosting and continuous operation. Each service is delivered against a proposal with clearly defined scope, deliverables, timings and owners.

The site may show:

  • General descriptions of services and products.
  • Public cases, metrics or screenshots (with the client's permission).
  • Editorial material (blog, resources).

All of the above is indicative. The actual offer takes shape in the signed proposal.

Proposals, prices and timelines

#

Published prices, timings and estimates are for reference. The final proposal depends on scope, technical risks, integrations, external dependencies and the level of operation required.

Unless agreed otherwise, a proposal is valid for 30 days. After that period it is reviewed according to market conditions, team availability and any newly identified risks.

Payments, invoicing and late payment

#

We charge in bolivianos (BOB) or US dollars (USD), as agreed in each proposal. We accept local bank transfer, international transfer (wire / SWIFT) and, for one-off operations, gateways such as Stripe or Mercado Pago.

Default scheme, adjustable per proposal:

  • Fixed projects: 50% up front, 50% on delivery or by milestones.
  • Continuous operation / retainer: monthly invoicing in advance.
  • Managed hosting: monthly or annual depending on the plan.

Late payment may lead to suspension of production services, with prior written notice of at least 5 working days. Invoices are issued in accordance with current Bolivian regulation and using the tax details the client provides.

Intellectual property and deliverables

#

Unless agreed otherwise in the proposal, once the corresponding payments are covered the client receives ownership of the source code and the specific deliverables produced for their project.

BLOKIS retains ownership of:

  • Internal frameworks, templates, components and reused in-house libraries.
  • Generic know-how, methods and internal tooling.
  • Its trademarks, logo and public site materials.

The client grants BLOKIS limited, revocable permission to show their name, logo and non-sensitive metrics as a client case, unless they expressly request otherwise.

Client data and confidentiality

#

The contact, commercial and operational data we receive is used solely to reply, contract, deliver and maintain the service. We do not sell it or share it with third parties except:

  • Strictly necessary providers (hosting, payments, communications).
  • Valid legal obligations in Bolivia or in the providers' jurisdictions.

We apply standard good security practice: role-based access control, encrypted secrets, audit logs on critical systems, least privilege and backups with a retention defined per project.

Cookies and trackers

#

This site uses cookies that are necessary for it to work (session, preferences, theme). Optionally, you can enable anonymous analytics or marketing cookies through the consent banner.

Full details, the cookie table and how to withdraw consent are in the cookie policy.

Limitation of liability

#

BLOKIS operates to high professional standards, but does not guarantee that software will be absolutely free of errors, nor that third-party services (cloud providers, gateways, banks, networks) will run without interruption.

BLOKIS's maximum liability towards the client, save for wilful misconduct or gross negligence, is limited to the amount actually paid by the client over the last 3 months for the service being claimed.

Nothing in these terms limits obligations that cannot be waived under Bolivian law.

Cancellation and termination

#

Either party may end the relationship with 30 days' written notice on continuous operation projects, unless the specific contract sets a different period.

In the event of a serious breach (non-payment, misuse of the service, breach of confidentiality), the complying party may terminate the contract immediately, without prejudice to any legal action that may follow.

On termination, BLOKIS hands over backups, access and documentation as agreed, within a reasonable period.

Jurisdiction and governing law

#

These terms are governed by the laws of the Plurinational State of Bolivia. Any dispute will first be addressed in good faith between the parties.

Failing agreement, the parties submit to the jurisdiction of the courts of Cochabamba, Bolivia, unless the specific proposal establishes a different mechanism (arbitration, for example).
